Description
¶0The appellant, Fowler Toyota, hired a man to repossess a car when the buyer of the car defaulted on his installment sales contract. The car was located at Williamson Auto for repairs. When the car was located by the repossessor, he cut a chain locked to the gate of Williamson Auto, and took the car from the lot. The owner, Jim Williamson, subsequently sued Fowler Toyota, and was awarded $45.00 in actual damages, and $15,000.00 in punitive damages, plus attorney fees and costs. Fowler Toyota appealed, and the Court of Civil Appeals reversed.
