December 5, 1952. This is an action under Lord Campbell's Act, Sections 411 and 412 of the Code of 1942, to recover damages for the alleged wrongful death of Herbert Hickson who was struck and instantly killed about 4:00 A.M. on Saturday morning, November 1, 1947, by a freight train of the Atlantic Coast Line Railroad, which was being operated upon the tracks of the Charleston & Western Carolina Railway Company, at a point about a half mile north of Bush's Station in Aiken County. The trial resulted in a verdict for the plaintiff in the sum of $3,625.00 actual damages. The only question which we find it necessary to determine is whether the Court erred in failing to grant defendant's motion for a nonsuit at the close of the plaintiff's testimony and later a motion for a directed verdict at the close of all the testimony, upon the ground that the plaintiff had failed to establish any actionable negligence on the part of the Railroad Company.
